1. Agreement to Terms

These Terms of Service ("Terms") govern the relationship between DailyNewLeads ("we," "us," or "our") and any home service or home improvement business ("you," "Client," or "Partner") that visits our website at dailynewleads.com, books a discovery call, or enters into a lead supply agreement with us.

By booking a call, submitting your business details, or receiving leads from us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Services

DailyNewLeads provides a pay-per-lead service for home service and home improvement businesses. Our service includes:

  • Running paid advertising campaigns to generate inbound homeowner enquiries
  • Qualifying homeowner enquiries based on service type, location, property ownership, and urgency
  • Delivering qualified, exclusive leads to your nominated contact method (SMS, email, or CRM)
  • Managing lead flow within agreed service areas and verticals

We fund 100% of advertising costs. You pay only per qualified lead delivered as agreed in your partnership terms.

3. Lead Exclusivity

Each qualified lead is delivered exclusively to one Partner business. We do not resell, share, or redistribute the same lead to multiple contractors. Exclusivity applies per vertical and per service area as defined in your onboarding agreement.

4. Consent to Communications

By submitting your business contact details on our website and booking a call, you consent to receive communications from DailyNewLeads via SMS, email, and phone. These communications may include:

  • Discovery call confirmations and reminders
  • Onboarding and account setup information
  • Lead delivery notifications
  • Billing and account updates
  • Marketing messages about our services and new verticals

You may opt out of marketing SMS messages at any time by replying STOP. Operational messages related to active lead delivery may continue until your account is closed.

5. Partner Obligations

As a lead buyer Partner, you agree to:

  • Follow up with delivered leads promptly — ideally within one hour of delivery
  • Carry appropriate business licences and liability insurance for your trade
  • Provide accurate service area and vertical information during onboarding
  • Notify us promptly if your capacity or service area changes
  • Handle all homeowner interactions professionally and in compliance with applicable laws
  • Not resell, transfer, or redistribute leads delivered to you

6. Billing and Payment

Lead pricing is agreed during your onboarding call and confirmed in writing. Payment terms are as specified in your individual partnership agreement. We reserve the right to pause or terminate lead delivery if payments are not made on time.

Lead fees are non-refundable once a lead has been delivered and contact details confirmed, except in cases where a lead clearly fails the agreed qualification criteria.

7. Lead Quality and Disputes

We make reasonable efforts to qualify every lead before delivery. If you believe a delivered lead does not meet the agreed qualification criteria, you must notify us within 48 hours of delivery with specific reasons. We will review disputes on a case-by-case basis.

We do not guarantee job conversion rates, contract values, or homeowner responsiveness after lead delivery. Our obligation is to deliver a qualified enquiry meeting the agreed criteria.

8. No Long-Term Contracts

There are no long-term contracts. You may pause or cancel your lead supply at any time by notifying us in writing. Active leads in transit at the time of cancellation will be delivered and billed as normal.

9. Prohibited Conduct

You agree not to:

  • Provide false or misleading information during onboarding
  • Resell or share leads with third parties
  • Use leads for any purpose other than legitimate home service sales outreach
  • Attempt to circumvent our systems or contact homeowners in a manner inconsistent with applicable law

10. Intellectual Property

All content, branding, and materials on the DailyNewLeads website are our property and protected by applicable intellectual property laws. You may not reproduce or use our content without prior written permission.

11. Disclaimer of Warranties

Our services are provided on an "as is" basis. We do not warrant that lead flow will be uninterrupted, that all leads will convert to booked jobs, or that any specific revenue outcome will be achieved. Lead volume is subject to market conditions and campaign performance.

12. Limitation of Liability

To the maximum extent permitted by law, DailyNewLeads shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim shall not exceed the total fees paid by you in the 30 days prior to the claim.

13. Privacy Policy

Your use of our website is also governed by our Privacy Policy, incorporated into these Terms by reference.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation in the first instance, followed by binding arbitration if unresolved.

15. Changes to Terms

We may update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
